Jurisdictional determinations

Prepared following stream and wetland delineations, jurisdictional determinations are application packages submitted to the USACE for the purpose of determining whether the delineated waters are Waters of the U.S., therefore making them subject to Section 404 of the Clean Water Act. Decota has extensive experience making the observations needed for determining jurisdiction, and therefore classifying a stream channel as either perennial, intermittent, or ephemeral or determining the jurisdictional status of a wetland. Decota coordinates with USACE and WVDEP when preparing jurisdictional determinations and accompanies regulatory agencies onsite for field verifications of the findings. Decota uses survey-grade GPS during their delineations, resulting in precise delineation mapping that is used by USACE during their application review.
